‘Withering rejection’: Trump loses presidential immunity fight—twice in one day

TWICE!

Judge Chutkan rejected Trump’s motion to dismiss his criminal charges based on a claim of “presidential immunity” on the same day a federal appeals court ruled that the former president can be sued for inciting the insurrection.

he truly believed that he had absolute power and now he is trying to use his personal beliefs to fight criminal charges. you can bet that, if he gets re-elected as president, he will work hard to establish absolute power , at least for him , as president.

If every public office holder, including the president, had total legal immunity for any of their actions during their term office, then they would have no accountability for any crimes other than being removed from office. This leads to any office holder having incentives to not only commit crimes while in office, but to then ensure that they stay in office no matter the consequences. Democracy relies on all citizens being held to the same standards, and for public office holders to be held to even higher standards.

Presidential immunity is vital, as it protects the POTUS when they must make hard decisions concerning their duties. Attempting to overthrow a free and fair election to retain the office by extra-constitutional means, however, is not part of the duties of the POTUS. Trump’s reading of the Constitutional is as accurate as his comments concerning the Presidential Records Act as well. A document that his legal team of Court Jesters claim he never swore an oath “to support”.

Trump’s lawyers need to quit making foolish arguments or repeating Trump’s. They need to argue he is incompetent to stand trial because of his insistence to pursue stupid arguments.
